Terms of Use

These Terms of Use (“Terms”) govern your access to and use of GullyHabits, including its website, applications, features and related services (“GullyHabits” or the “Service”).

GullyHabits is owned and operated by Gully System Pvt. Ltd. (“Gully System,” “we,” “us” or “our”).

By registering, purchasing a subscription or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use GullyHabits.

1. Eligibility

You must be at least 18 years old and legally capable of entering into a binding contract to create an account or purchase a subscription.

By using GullyHabits, you represent that the information you provide is accurate and that you meet these eligibility requirements.

2. About GullyHabits

GullyHabits is a personal goal, task, planning and recurring-action management application. It may help you:

  • Organise areas of your life
  • Create and monitor goals
  • Schedule tasks
  • Create recurring actions
  • Set reminders
  • Review completion and progress

GullyHabits provides organisational tools only. It does not guarantee that you will complete a task, maintain a habit or achieve a particular personal, professional, business, health or financial outcome.

3. Not Professional Advice

Information and features provided through GullyHabits do not constitute medical, mental-health, legal, financial, investment, tax or other professional advice.

You are responsible for your decisions and should consult a qualified professional where appropriate. Do not use GullyHabits as a substitute for emergency services, professional diagnosis or treatment.

4. Account Registration

To use certain features, you must create an account and provide accurate, current and complete information.

You agree to:

  • Keep your account information updated
  • Protect your login credentials
  • Maintain a strong and confidential password
  • Accept responsibility for activity performed through your account
  • Notify us promptly of suspected unauthorised access

One individual account is intended for one user unless we expressly permit otherwise. You may not sell, transfer, share or sublicense your account.

5. Free Trial

Eligible new users may receive a 14-day free trial with access to the features described on the Pricing page.

  • Payment details are not required to begin the advertised trial unless clearly stated otherwise before registration.
  • The trial begins when your account is activated.
  • No automatic charge will occur at the end of a payment-free trial.
  • You must purchase the annual subscription to continue using paid features after the trial.
  • We may restrict repeated, duplicate, fraudulent or abusive trial registrations.

We may change or withdraw future trial offers, but doing so will not reduce a trial already granted unless misuse has occurred.

6. Subscription and Payment

The standard individual subscription is currently ₹999 for 12 months, subject to applicable taxes shown before payment.

By purchasing a subscription, you agree that:

  • You will pay the displayed price and applicable taxes.
  • Access begins after successful payment confirmation.
  • The subscription is intended for individual use.
  • The current plan includes the features described on the Pricing page.
  • Payment is processed through an authorised third-party payment provider.
  • A payment receipt or tax invoice will be issued as applicable.

We may change pricing or features prospectively. Changes will not reduce your already-paid subscription period. Any new renewal price will be communicated or displayed before it applies, as required by law.

7. Renewal and Cancellation

If automatic renewal is offered and you authorise it:

  • Your subscription may renew for another annual period using the authorised payment method.
  • The price, billing frequency and renewal terms will be shown before you approve the mandate.
  • You may cancel future renewal using your account settings or by contacting support.
  • Cancelling renewal does not immediately terminate access; you may continue using the Service until the end of the paid period.
  • Renewal remains subject to payment-provider and banking requirements.

If automatic renewal is not enabled, your subscription will expire unless you manually purchase another term.

8. User Content

“User Content” means goals, tasks, notes, categories, schedules and other information you submit to GullyHabits.

You retain ownership of your User Content. You grant us a limited, non-exclusive licence to host, store, reproduce, transmit and process it solely as required to:

  • Operate the Service
  • Synchronise and display your information
  • Maintain security and backups
  • Provide support
  • Comply with applicable law

You are responsible for your User Content and must have the right to submit it.

Do not upload unnecessary confidential information or personal data about another person without an appropriate legal basis or permission.

9. Acceptable Use

You must not:

  • Use the Service for unlawful, fraudulent or harmful activity
  • Attempt to access another user’s account or information
  • Introduce malware or malicious code
  • Interfere with the security or operation of the Service
  • Probe, scan or test vulnerabilities without written authorisation
  • Reverse engineer the Service except where the law expressly permits it
  • Copy, resell or commercially exploit the Service without permission
  • Use automated systems to overload, scrape or extract information
  • Circumvent subscriptions, access restrictions or security controls
  • Misrepresent your identity or affiliation
  • Upload content that infringes another person’s rights
  • Use the Service to threaten, harass or harm another person

We may investigate suspected misuse and take reasonable protective action.

10. Reminders and Notifications

Reminders depend on factors including:

  • Your selected date and time
  • Time-zone and notification settings
  • Internet and device availability
  • Browser or operating-system permissions
  • Third-party notification services

We do not guarantee that every reminder will be delivered at a particular time. You remain responsible for important appointments, payments, deadlines, medication and other time-sensitive obligations.

11. Intellectual Property

GullyHabits—including its software, design, branding, text, graphics, interfaces and underlying technology—is owned by or licensed to Gully System Pvt. Ltd. and protected by applicable intellectual-property laws.

We grant you a limited, personal, non-exclusive, non-transferable and revocable right to use the Service during your authorised trial or subscription.

No ownership rights are transferred to you.

12. Feedback

If you provide suggestions or feedback, you permit us to use them without restriction or payment, provided we do not publicly identify you without permission.

13. Third-Party Services

The Service may depend on or link to third-party services, including payment, hosting, analytics and notification providers.

We do not control third-party services and are not responsible for their independent terms, availability or conduct. Your use of them may be subject to additional terms.

14. Availability and Changes

We aim to provide a reliable Service, but we do not guarantee uninterrupted or error-free availability.

We may:

  • Perform maintenance
  • Correct errors
  • Improve or change features
  • Introduce reasonable usage limits
  • Discontinue obsolete functionality
  • Temporarily restrict access for security or operational reasons

If we permanently discontinue the paid Service before the end of your subscription, we will provide an appropriate remedy where required by applicable law.

15. Suspension and Termination

You may stop using GullyHabits at any time and may request account deletion.

We may suspend or terminate access if:

  • You materially breach these Terms
  • Payment is reversed, fraudulent or unauthorised
  • Your use creates security or legal risk
  • We are required to do so by law
  • You misuse the Service or interfere with other users

Where reasonably possible, we will provide notice and an opportunity to remedy the issue. Immediate action may be taken where necessary for security, fraud prevention or legal compliance.

Termination does not automatically create a right to a refund.

16. Disclaimers

To the extent permitted by law, GullyHabits is provided on an “as available” basis.

We do not warrant that:

  • The Service will always be uninterrupted or error-free
  • Every reminder will be delivered
  • The Service will meet every individual requirement
  • Use of the Service will produce a specific result
  • All data can always be recovered following user deletion, device failure or events beyond our reasonable control

Nothing in these Terms excludes warranties or rights that cannot lawfully be excluded.

17. Limitation of Liability

To the maximum extent permitted by applicable law, Gully System Pvt. Ltd. will not be liable for indirect, incidental, special, punitive or consequential losses, including loss of profits, opportunities or data, arising from use of the Service.

Where liability cannot be excluded, our aggregate liability relating to the Service will not exceed the amount you paid for GullyHabits during the 12 months preceding the event giving rise to the claim.

These limitations do not apply where liability cannot legally be limited, including liability resulting from fraud, wilful misconduct or other non-excludable statutory obligations.

18. Indemnity

To the extent permitted by law, you agree to indemnify Gully System Pvt. Ltd. against third-party claims arising directly from your unlawful use of the Service, violation of these Terms or infringement of another person’s rights.

19. Privacy

Our collection and use of personal data are explained in the Privacy Policy, which forms part of your relationship with us.

20. Changes to These Terms

We may revise these Terms when the Service, business practices or applicable laws change.

Material changes will be communicated through the Service, email or another reasonable method. Changes will apply prospectively from the stated effective date. Continued use after that date constitutes acceptance where permitted by law.

21. Governing Law and Jurisdiction

These Terms are governed by the laws of India.

Subject to applicable consumer-protection rights and any mandatory dispute-resolution requirements, courts in Bengaluru, Karnataka, India will have jurisdiction over disputes relating to these Terms or the Service.

Before commencing formal proceedings, you and Gully System agree to attempt to resolve the dispute in good faith by contacting the other party.

22. General Provisions

If a provision is found unenforceable, the remaining provisions will continue to apply.

Our failure to enforce a provision is not a waiver of that provision. You may not transfer your rights or obligations without our written permission. We may transfer our rights as part of a merger, restructuring or sale of the relevant business.

These Terms, the Privacy Policy and the Refund and Cancellation Policy constitute the agreement governing your use of GullyHabits.
